Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

811 – Anas (may Allah be pleased with him) reported: “The Prophet ﷺ passed by a date lying on the road and said: ‘Had I not feared that it might be from the charity, I would have eaten it.’ ” Agreed upon (1).

Points derived from the ḥadith

  1. The report shows that a trivial amount of fallen property becomes the finder’s own the moment he picks it up; no public announcement is required if the owner is unknown. Should the owner later be identified while the item is still intact, it must be returned; if it has already been consumed, no compensation is due.
  2. It highlights the Prophet’s humility ﷺ: despite his lofty station, he did not deem it beneath him to pick up and eat something so small, recognizing it as a blessing from Allah.
  3. Zakāt is forbidden to the Prophet ﷺ and to his family from Banū Hāshim, as Muslim relates that he ﷺ said, “Charity is not fitting for the family of Muhammad; it is only the impurities of people.”
  4. The narration further illustrates the Prophet’s scrupulousness ﷺ. The single date was lawful for him as a negligible lost-and-found item, and it had not been confirmed as charity, yet his piety kept him from anything even remotely doubtful.

Some have said that all aspects of waraʿ (scrupulousness) are gathered in his ﷺ statement: “Part of a person’s excellence in Islam is to leave what does not concern him.”

This encompasses speech, gaze, gatherings, actions, walking, and every outward and inward movement; this comprehensive prophetic wisdom suffices as a guide to waraʿ.

Imām al-Khaṭṭābī remarked: “Whenever you are uncertain about something, the path of scrupulousness is to avoid it.”
