may lawfully reclaim it in accordance with hadith no. 802; furthermore, there is nothing disgraceful about the act, for a father’s wealth and that of his child are effectively one, so it is as though he merely moved his own property from one place to another.
5 – The jurists stipulate four conditions for a father’s taking back what he had gifted to his child:
– The gift must be a specific item that is still in the child’s ownership.
– That item must remain under the child’s control and not have passed to someone else through a sale, an unreleased pledge, or the like.
– It must not have undergone any inseparable increase while with the child, such as fattening or pregnancy; such growth belongs to the donee, and once it occurs the father may no longer reclaim either the increase or the original asset.
– The father must not have previously waived his right of return, nor may he reclaim if the son has become insolvent and his property is under sequestration. Al-Hārithī said, “This is the correct view without any disagreement,” and al-Muwaffaq stated it explicitly.
