778 – It is related from Ḥakīm ibn Ḥizām (may Allah be pleased with him) that whenever he put money in a muqārada (mudaraba partnership) he would stipulate to the agent: “Do not invest my capital in any creature with a moist liver, do not transport it by sea, and do not stop with it in the bed of a flood-course. If you do any of these things, you are liable for my capital.” Al-Dāraquṭnī transmitted this report, and its narrators are reliable. (1)
Mālik recorded in the Muwaṭṭaʾ, from al-ʿAlāʾ ibn ʿAbd al-Raḥmān ibn Yaʿqūb, from his father, from his grandfather, “that he worked with money belonging to ʿUthmān (may Allah be pleased with him) on the understanding that the profit would be shared between them.” This is a sound mawqūf report. (2)
Degree of authenticity:
• The hadith is ṣaḥīḥ.
• The author writes: “Al-Dāraquṭnī narrated it and its transmitters are trustworthy.”
• In al-Talkhīṣ it is stated: “Al-Bayhaqī transmitted it with a strong chain that meets the conditions of the Two Shaykhs, and it is a sound mawqūf report.”
• As for the report of ʿUthmān: its transmitters are trustworthy and are the narrators of Muslim, except for Yaʿqūb al-Madanī; al-Ḥāfiẓ said of him: ‘acceptable.’
Lexical notes:
