After reviewing the study prepared for this purpose by the Permanent Committee for Scholarly Research, and following the members’ deliberations, discussions, and exchange of views, the Council resolved—by a majority vote—that the right of shufʿah is affirmed in undividable real estate, such as a small house, a small shop, and similar properties. This ruling is based on the general body of evidence, on the fact that such cases fall under the rationale for shufʿah—namely, preventing harm to the partner in the sold property—and because the scriptural texts that legislate shufʿah clearly include this situation.
