- Abu Hurayrah (may Allah be pleased with him) reported that the Messenger of Allah (blessings and peace be upon him) said, “A pledge is not to be foreclosed by the one who pawned it; its profit is his, and its liability is on him.” Al-Daraqutni and al-Hakim transmitted it, and its narrators are trustworthy—except that the version preserved by Abu Dawud and others is mursal.⦗1⦘
Grading of the hadith:
This report was related by Malik, al-Shafi‘i, Ibn Majah, al-Daraqutni, al-Hakim, al-Bayhaqi, and Ibn Hibban.
The pupils of al-Zuhri differed over whether the chain is continuous or mursal. Malik, Ibn Abi Dhi’b, Ma‘mar, and Yunus narrated it from al-Zuhri, from Sa‘id ibn al-Musayyib, as a mursal report.
Abu Dawud, al-Bazzar, al-Daraqutni, al-Bayhaqi, and Ibn al-Qattan declared this mursal version sound.
Those who reported it with a connected chain are Ziyad ibn Saʿd and Isḥaq ibn Rashid, from al-Zuhri, from Sa‘id ibn al-Musayyib, from Abu Hurayrah, as a marfūʿ report.
Al-Hakim said, “It is authentic according to the criteria of the two Shaykhs, though they did not include it because al-Zuhri’s students disagreed over it,” and al-Dhahabi concurred. Ibn ʿAbd al-Barr and ʿAbd al-Haqq also affirmed the connected chain. Al-Daraqutni stated, “Ziyad ibn Saʿd is one of the reliable ḥuffāẓ,” concluding that the isnad is sound and continuous.
Al-Bayhaqi cited this judgment, then added, “Others have narrated it from Sufyan, from Ziyad, as a mursal report, and that is the version that is better preserved.”
