Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

the people, for if the standard were unknown, exact fulfillment would be impossible. This is drawn from the phrase, “in a known measure.” Ibn al-Munadhir said, “Everyone whose opinion we have recorded agrees that salam in foodstuffs is not valid when the bushel’s capacity is unknown, nor in a garment measured by so-and-so’s ell; for if that standard were lost, or the person died, the salam would be void.”

7 – The well-known view in Imam Aḥmad’s school is that if the salam is concluded in a commodity normally sold by volume but is specified by weight, or in something usually weighed but is specified by measure, the contract is invalid. Another report—preferred by al-Muwaffaq (Ibn Qudāmah)—states that it is valid. Al-Athram said, “Here people do not know any volumetric measure for fruit,” and this is likewise the position of the three other Imams.

8 – Fifth: The term must be clearly defined; a salam deferred to an unknown time limit is invalid. This is inferred from the wording, “for a specified term.” Shaykh ʿAbdullāh, son of Shaykh Muḥammad, said, “If one sells ‘until harvest’ or ‘until the dates are picked,’ some scholars deem that a definite term.” This is the position of Imam Mālik and others. Ibn ʿUmar used to purchase on salam until the army stipend was distributed; this, too, is a report from Imam Aḥmad, preferred by the author of al-Fāʾiq and by our teacher ʿAbd al-Raḥmān al-Saʿdī.

9 – Sixth: The salam must be a liability in the seller’s debt; it is invalid to tie it to a specific item, such as a particular tree, for that item might perish before delivery falls due. This is taken from the narrator’s words, “They asked him, ‘Did they own any crops?’ He said, ‘We never asked them about that,’” which shows that the salam related to a debt obligation, not to designated objects.

10 – Seventh: The commodity contracted in the salam must, in most cases, be available when the term falls due, because delivery becomes obligatory then. If it is unavailable at that time, or available only rarely, the contract is invalid, for it would be impossible to deliver the commodity when required. This condition is derived from the phrase “for a specified term,” for the preposition “until” marks the deadline by which the commodity must be handed over. Hence, if the item is rarely found, it cannot be delivered by that known deadline.
