705 – ʿAmr ibn Shuʿayb, from his father, from his grandfather (may Allah be pleased with him), relates that the Prophet ﷺ said:
“The seller and the purchaser each retain the option (khiyār) until they part company, unless the transaction is a ṣafqat khiyār (a sale concluded on the understanding that the sitting-place option is waived). It is not lawful for either of them to leave the other merely out of fear that he might ask to rescind the deal.”
Narrated by the Five compilers except Ibn Mājah, and also by al-Dāraquṭnī, Ibn Khuzaymah, and Ibn al-Jārūd. In another wording: “…until they separate from the very place where they are sitting.” (1)
Hadith grading
This hadith is ḥasan.
Al-Albānī said: It was recorded by al-Nasāʾī, al-Tirmidhī, and Abū Dāwūd through the chain of ʿAmr ibn Shuʿayb.
Al-Tirmidhī remarked, “A ḥasan ḥadīth,” and noted that after an earlier dispute the overwhelming majority of hadith critics came to accept the reports of ʿAmr ibn Shuʿayb from his father from his grandfather as admissible evidence.
Al-Dāraquṭnī said: “He is ʿAmr ibn Shuʿayb ibn Muḥammad ibn ʿAbd Allāh ibn ʿAmr ibn al-ʿĀṣ; it has been soundly established that ʿAmr heard from his father Shuʿayb, and that Shuʿayb heard from his grandfather ʿAbd Allāh ibn ʿAmr.”
Al-Bukhārī was asked, “Did Shuʿayb actually hear from ʿAbd Allāh ibn ʿAmr?” He replied: “I saw ʿAlī ibn al-Madīnī, Aḥmad ibn Ḥanbal, al-Humaydī, and Isḥāq [ibn Rāhawayh] relying on his narrations.”
