Allah will rescue him from his stumble on the Day of Resurrection.”
3 – Rescission is valid without the conditions required for a sale, for it merely annuls the contract and does not constitute a new transaction. Hence it is permissible even before the buyer has taken possession, and it is allowed with merchandise sold by measure, by weight, by count, by length, or with standing crops, without the need to carry out the measuring, weighing, counting, or estimating procedures.
In summary, rescission is not bound by the rules and stipulations of sale, because it only removes and cancels the contract.
4 – A rescission is not valid if it involves an increase over, a decrease below, or a change in the original price, for the very purpose of rescission is to restore the matter to its former state.
5 – Any profit or detached increment that accrues from the sold item belongs to the buyer, in accordance with the hadith, “Profit follows liability.” Whatever separate growth the item produces is deserved by the one who bears its liability for as long as it remains in his possession prior to rescission.
