It is stated in al-Muntahā and its commentary that when a purchaser rescinds a sale because of a defect, he is not obliged to return any yield that has separated from the item in the meantime, such as fruit or the offspring of livestock. Whatever earnings the item generated from the moment of contract until it is returned likewise belong to him, by virtue of the ḥadīth, “The right to profit goes hand in hand with responsibility for loss.” Had the goods perished during that period, the loss would have been his.
- The jurists differ on this issue and offer various details concerning what the buyer may keep and what he must return along with the merchandise when it is sent back to the seller. The conclusion adopted here follows the position of the two Imams, al-Shāfiʿī and Aḥmad, and it is the view indicated by the ḥadīth, “The right to profit goes hand in hand with responsibility for loss.”
