697 – ʿĀʾishah (may Allah be pleased with her) narrated that the Messenger of Allah ﷺ said: “Al-kharāj bi’l-ḍamān” (“The right to profit goes hand in hand with responsibility for loss”).(1) It was transmitted by the Five compilers of the Sunan, and was judged weak by al-Bukhārī and Abū Dāwūd, while al-Tirmidhī, Ibn Khuzaymah, Ibn al-Jārūd, Ibn Ḥibbān, al-Ḥākim, and Ibn al-Qaṭṭān declared it sound.
Degree of authenticity
The hadith is graded ḥasan (fairly sound).
The author states: It was narrated by the Five and authenticated by al-Tirmidhī, Ibn Khuzaymah, Ibn al-Jārūd, Ibn Ḥibbān, al-Ḥākim, and Ibn al-Qaṭṭān.
Al-Bukhārī and Abū Dāwūd deemed it weak; al-Bukhārī did so because the chain contains Muslim ibn Khālid al-Zanjī, whose narrations are considered unreliable.
In al-Talkhīṣ Ibn Ḥajar records that Ibn al-Qaṭṭān classed it as sound, whereas Ibn Ḥazm held that it is not authentic.
Al-Tirmidhī said: “A ḥasan ṣaḥīḥ gharīb (sound, authentic, singular) hadith.”
Al-Albānī commented: “All of its transmitters are trustworthy and belong to the narrators accepted by the two Shaykhs, except for Mukhlid ibn Khuffāf.”
Ibn Ḥibbān declared Mukhlid reliable, and Ibn Ḥajar judged him “acceptable when corroborated.” In this narration he is indeed corroborated, and the scholars have generally accepted the hadith.
Vocabulary
– al-kharāj: with an open khāʾ followed by a lightly pronounced rāʾ; it refers to revenue or rent, that is, the profits and benefits derived from the sold property.
