Resolution of the Islamic Fiqh Academy on the Change in Currency Value:
The Council of the Islamic Fiqh Academy, convened for its fifth conference in Kuwait from 1–6 Jumada al-Ula 1409 AH / 10–15 December 1988 CE, after examining the papers submitted by its members and experts on “the change in currency value,” listening to the discussions that took place on the subject, and reviewing Resolution no. 9 from the third session—which affirmed that paper money is legal tender possessing full thamaniyyah and is therefore subject to the same rulings as gold and silver with respect to usury, zakat, salam, and all related injunctions—
resolved as follows: In the settlement of debts fixed in a given currency, what counts is repayment in the same nominal units, not in their present value, for debts are discharged by their like. Hence it is impermissible to index debts established in the liability—whatever their source—to the level of prices. Allah knows best. -
