Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

to this day. Some manuscript copies, however, read it as “al-Naqīʿ”—spelled with an initial nūn, a qāf with kasrah, a quiescent yāʾ beneath it, and a final un-dotted ʿayn. Al-Naqīʿ is a site west of Medina that the Prophet ﷺ declared a protected pasture; it is still under that protection today and lies about 75 km from the city. Even so, the dominant view among the ḥadith transmitters is that the correct reading begins with a bāʾ, i.e. al-Baqīʿ.

• Dinars (dīnār): the Islamic gold coin; one dinar weighs one mithqāl, roughly 4.25 g.
• Dirhams (dirham): the Islamic silver coin; a dirham weighs about 2.975 g.

Points derived from the ḥadith

  1. The report shows that a debt in gold may be settled with silver and a debt in silver with gold. This falls under ṣarf, which the jurists define as “exchanging one currency for another, whether of the same genus or of a different one.”
  2. For the exchange to remain valid, the two parties must not leave the session of contract while anything between them is still outstanding; each must take possession of what he contracted for the other.
  3. If they part before taking delivery, the contract is void with respect to whatever has not been received. Should part of it be received while the rest remains, the contract is void only for the portion not yet delivered, because its condition has been breached.
  4. Exchange is permissible even when only one of the two currencies is physically present and the other is a debt, provided they do not separate while anything is still due. This is what the ḥadith of the chapter intends, for it appears that only one of the two currencies was on hand.
  5. The phrase “at the day’s price” occurs in the ḥadith, but consensus holds that it is not a binding restriction. Al-Khaṭṭābī said that Ibn Abī Laylā disliked the transaction unless it was “at that day’s price,” whereas the rest of the scholars did not consider price a condition. For Muslim’s Ṣaḥīḥ (1587) records that ʿUbādah ibn al-Ṣāmit narrated: The Messenger of Allah ﷺ said, “Gold for gold and silver for silver, equal for equal; but when these kinds differ, sell as you wish, provided it is hand to hand.”
