As for the majority of the jurists, they hold that the ruling applies to every commodity without exception: it is impermissible to dispose of what one has purchased until it has been received and transferred. This has already been stated under ḥadith no. (677).
- Shaykh ʿAbd al-Raḥmān ibn Qāsim said: The prohibition against selling food before taking possession of it is recurrently attested, with no difference between bulk goods and those sold by measure, for the following reasons:
• Al-Bukhārī (2137) and Muslim (1526) relate from Ibn ʿUmar: “People used to trade foodstuffs in bulk in the upper part of the market, and the Prophet ﷺ forbade them to resell any of it until they had moved it to their own quarters.”
• Aḥmad (14773) transmits from Ḥakīm ibn Ḥizām that the Messenger of Allah ﷺ said, “When you buy something, do not sell it until you have taken possession of it.”
• Abū Dāwūd (3036) narrates from Zayd ibn Thābit that “the Prophet ﷺ forbade merchandise to be sold at the very spot where it was acquired, until the traders had carried it to their own quarters.”
These ḥadiths and others of the same purport show that no commodity may be resold until the buyer has received it in full and taken possession of it.
Ibn al-Qayyim stated: “It is never permissible to sell any goods before taking possession of them; this is among the refinements of the Sharīʿah. The textual proof specifically covers food, and by either direct analogy or a fortiori reasoning the same prohibition applies to everything else.”
