- ʿAmr ibn Shuʿayb, from his father, from his grandfather—may Allah be pleased with him—reported that the Messenger of Allah ﷺ said: “It is not lawful to combine a loan with a sale, nor two stipulations in one sale; nor to take profit on property for which you have not assumed liability; nor to sell what is not in your possession.” The Five compilers narrated it, and al-Tirmidhi, Ibn Khuzaymah, and al-Ḥākim declared it sound.
It is also cited in ʿUlūm al-Ḥadīth through the transmission of Abū Ḥanīfah from the same ʿAmr with the wording: “He forbade a sale together with a stipulation.” Al-Ṭabarānī recorded it from this same route in al-Awsat, and it is a solitary report (1).
Hadith grading
The hadith is ḥasan when the various chains are considered together. In at-Talḵīṣ it is noted that Mālik related it as an unconnected report, while al-Bayhaqī transmitted it with a continuous chain from ʿAmr ibn Shuʿayb; al-Tirmidhi ruled it sound. Additional chains appear in al-Nasāʾī and al-Ḥākim through ʿAṭāʾ al-Khurāsānī from ʿAbd Allāh ibn ʿAmr, although al-Nasāʾī remarked that ʿAṭāʾ did not hear directly from ʿAbd Allāh ibn ʿAmr. Al-Bayhaqī also narrates it from Ibn ʿAbbās, and al-Ṭabarānī from Ḥakīm ibn Ḥizām. Al-Shawkānī states that Ibn Khuzaymah, al-Ḥākim, and Ibn Ḥibbān authenticated the hadith, all on the authority of ʿAmr ibn Shuʿayb from his father from his grandfather. Ibn Ḥazm included it in al-Muḥallā, al-Khaṭṭābī in al-Maʿālim, and al-Ṭabarānī in al-Awsat.
