- As already noted, the first release (taḥallul) is not obtained unless both the stoning and the shaving are completed. This is the opinion of Ibn al-Zubayr, ʿĀʾishah, ʿAlqamah, Sālim, Ṭāwūs, and al-Nakhaʿī, and it is likewise the position of Imām Abū Ḥanīfah, al-Shāfiʿī, Abū Thawr, and—according to the well-known view—Imām Aḥmad, all of them acting upon this ḥadīth in its various chains.
Al-Sharḥ al-Kabīr states: “The other narration is that the release is achieved by the stoning alone.” This is the view of ʿAṭāʾ, Mālik, and Abū Thawr. Our teacher—the author of al-Mughnī—said: “This, Allah willing, is the correct view, because of the Prophet’s ﷺ statement in the ḥadīth of Umm Salamah: ‘When you have cast the Jamrah, everything becomes lawful for you except women.’”
After citing the ḥadīth of Umm Salamah, al-Shawkānī wrote: “It is taken as evidence that by casting Jamrat al-ʿAqabah all the prohibitions of iḥrām are lifted except sexual intercourse with women, for that remains unlawful by consensus.”
Shaykh Nāṣir al-Dīn al-Albānī said: “When the pilgrim in iḥrām has thrown Jamrat al-ʿAqabah, everything becomes permissible for him except women, even if he has not yet shaved, on the strength of the ḥadīth of ʿĀʾishah: ‘I applied perfume to the Messenger of Allah ﷺ with my own hands during the Farewell Pilgrimage for both his state of iḥrām and his release, and on the Day of Sacrifice when he threw the Jamrah before he circumambulated the House.’ Its chain is authentic according to the criteria of the two Shaykhs (al-Bukhārī and Muslim), and this is also the view adopted by Ibn Ḥazm.”
