Ibn al-Qayyim said: “The pilgrim’s hady (sacrificial offering) has the same standing for him as the uḍḥiyah (‘Eid sacrifice) has for the resident. Nothing has been transmitted from the Prophet ﷺ or any of his Companions to show that they combined a hady with a separate uḍḥiyah; rather, their hady served as their uḍḥiyah. Thus, when the animal is offered in Mina it is deemed a hady, and outside Mina it counts as an uḍḥiyah. If someone buys the animal at ʿArafat and then drives it on to Mina, the scholars unanimously agree that it is a hady. If, however, he purchases it in Mina and slaughters it there, the jurists disagree: in Mālik’s school it is not a hady, whereas the other three schools hold that it is.

Shaykh Muḥammad ibn Ibrāhīm said: “The hady offerings were legislated in the Hajj in imitation of Allah’s close friend Abraham, when Allah commanded him to sacrifice his son Ishmael, and the Muslims have kept to this practice generation after generation. To belittle the importance of the prescribed slaughter or to replace it with something else is one of Satan’s promptings to certain individuals. These animals are to be slaughtered by Allah’s decree as an act of worship and veneration of Him, and so that both the modest poor and the petitioner may eat from them.”
Decision of the Council of Senior Scholars regarding the slaughter of hady and uḍḥiyah
Its conclusions are as follows:
- It is not permissible to replace the slaughter of the hady of tamattuʿ or qirān with giving its cash value in charity. The Qur’an, the Sunnah, and the consensus of the scholars all indicate this, and the legal maxim of blocking the means applies here; allowing payment in lieu of slaughter would lead to tampering with the Sharia.
- By majority vote the Council ruled that the days for slaughter are four: the day of Eid and the three days that follow. It is also permissible to slaughter during the nights of the Days of Tashrīq. Shaykh ʿAbd al-Razzāq al-ʿAfīfī dissented, allowing slaughter after the Days of Tashrīq, and he incurs no sin for that view.
- Slaughter is not restricted to Mina; it may be performed in Mecca or anywhere within the Sacred Precinct.
