6 – Shaykh Taqī al-Dīn said: Only the two Yamānī corners are to be touched, not the two Shāmī corners, for the Prophet ﷺ touched only the Yamānī pair. The reason is that those two rest upon Abraham’s foundations, whereas the other two lie inside the House, as the Prophet ﷺ himself clarified.
7 – He further stated: As for the remaining sides of the Kaʿbah, the Station of Abraham, the Chamber of the Prophet ﷺ, the graves of the prophets and the righteous, and the Rock of Jerusalem, performing circuits around them, touching them, or kissing them ranks among the gravest forbidden innovations, by unanimous agreement of the four Imams.
8 – Al-Nawawī said: On the strength of this report, the jurists of the Mālikī and Ḥanbalī schools concluded that the urine and dung of animals whose meat is lawful to eat are pure, for one cannot be sure that a camel will not soil the mosque. Had such matter been impure, the Prophet ﷺ would not have exposed the mosque to it.
Resolution of the Council of Senior Scholars regarding the ruling on performing ṭawāf on a section of the roof above the Saʿy area
All praise is due to Allah, and may blessings and peace be upon the Messenger of Allah, his family, Companions, and all who follow his guidance. To proceed:
The Council of Senior Scholars, in its fifty-third session held in Ṭāʾif from 12/5/1421 AH to 15/5/1421 AH, examined the ruling on performing ṭawāf, during periods of extreme congestion, on a portion of the roof over the Saʿy course. The matter was placed on the agenda because of the many inquiries submitted to the Permanent Committee for Scholarly Research and Fatwas on this question.
After due study, the Council, by majority vote, ruled that it is impermissible to perform ṭawāf on any part of the roof above the Saʿy area, because that course is considered outside the Sacred Mosque and is not part of it. Rather, it is a separate sacred site with its own rulings and acts of worship, whereas ṭawāf is confined to the Sacred Mosque, as Allah the Exalted says: “and let them circumambulate the Ancient House” (Quran 22:29).
In order to resolve this difficulty, the Council reviewed a letter from His Excellency the President
