The Muslims unanimously agree that departing from Muzdalifah before sunrise is a Sunnah.
57 – One should hasten through Wadi Muhassir, the valley that separates Muzdalifah from Mina. The manner of this haste is the same as when he left ʿArafah: whenever he finds an opening he loosens his camel’s rein and urges it forward.
58 – On the Day of Sacrifice he begins by stoning Jamrat al-ʿAqabah; this is done after sunrise, and on that day no other jamrah is to be stoned.
59 – The pebbles should be roughly the size of a broad-bean or fava bean.
60 – Sacrificial slaughter is obligatory for every non-Meccan pilgrim who is performing either qirān or tamattuʿ.
Ibn al-Munthir and Ibn ʿAbd al-Barr said: The scholars are unanimously agreed that anyone who enters iḥrām for ʿumrah during the months of ḥajj, completes it, is not one of the residents of the Sacred Mosque, then remains in Mecca in a state of release until he performs ḥajj in that same year, is a mutamattiʿ and must offer a blood sacrifice.
Our jurists have set seven conditions for this sacrifice to become obligatory upon the mutamattiʿ:
- He must enter iḥrām for the ʿumrah from the miqāt or from a point at least the distance that permits shortening the prayer from Mecca.
- He must enter iḥrām during the months of ḥajj. The three Imams add that it is sufficient if he performs the ṭawāf of ʿumrah in Shawwal.
- He must perform ḥajj in that same year; this too is affirmed by the three Imams.
- He must not travel a distance that allows shortening the prayer between his ʿumrah and ḥajj; this also is the view of the three Imams.
- He must intend tamattuʿ when he first enters iḥrām. Shaykh al-Muwaffaq chose the opinion that this is not required, which is likewise the Shafiʿi view.
- He must exit the state of ʿumrah before entering iḥrām for ḥajj.
- He must not be among the residents of the Sacred Mosque—this is a point of consensus.
61 – His statement, “Then he mounted … and poured forth to the House,” means that he performed ṭawāf al-ifāḍah, which is a pillar without which the ḥajj is not complete. Whoever does not perform it may not depart until he does so.
