Tawḍīḥ al-AḥkāmAbd Allah al-Bassam
  1. Al-Kharqī states in Al-Iqnāʿ and its commentary: Kissing is disliked only for the one whose desire is stirred by it, in light of ʿĀʾishah’s report. If he expects that ejaculation will follow the kiss, it is forbidden by unanimous agreement. For the person whose desire is not aroused, it is not disliked; and the same ruling applies to every other prelude to intercourse—touching, repeated gazing, and the like—all are treated exactly like kissing. This distinction is supported by the report in Abū Dāwūd (2387): the Prophet ﷺ forbade it for a young man yet allowed it for an elderly one. Imām al-Shāfiʿī said, “There is no harm in it so long as it does not incite his desire.”

  2. The Prophet ﷺ used to kiss and engage in physical contact while fasting, yet he exercised the greatest self-control of anyone, so that no ejaculation or inner agitation followed his kisses; as ʿĀʾishah (may Allah be pleased with her) said, “But he was the most self-restrained of you with respect to his desire.”

  3. It is permissible to speak about matters that people normally feel shy to mention when doing so serves to make the truth clear, inform a treating physician, present evidence in court, settle disputes, or provide instruction.

  4. The community has benefited immensely from the Prophet’s wives ﷺ, for they transmitted legal rulings that no one but they could have known.

  5. If someone kisses or touches his wife and then ejaculates, the four Imams agree that his fast is broken. Ibn al-Mundhir, al-Muwaffaq Ibn Qudāmah, and others related consensus on this point, and it is the correct view, in light of the Divine hadith: “He leaves his food, drink, and desire for My sake.”

  6. As for the discharge of pre-ejaculatory fluid (madhī) through such contact, the dominant view in the Ḥanbalī school is that it invalidates the fast, and most of its scholars adopt this opinion. Another narration from Imām Aḥmad, however, holds that the fast is not nullified by madhī; this is also the position of Abū Ḥanīfah and al-Shāfiʿī, and was preferred by Shaykh Taqī al-Dīn, supported in Al-Furūʿ, and judged correct in Al-Inṣāf. This follows the basic presumption, and the analogy drawn between madhī and semen (manī) is invalid because the differences between them are clear. Hence, the categories are three:
