Modern chemists state that minerals are an organic substance found in nature, possessing a definite chemical composition and specific physical properties, and that minerals are made up of the very same chemical elements—such as gold, iron, and mercury.

Al-Qabaliyyah—with both the qāf and bāʾ pronounced with a fatḥah—is a locality along the Red Sea coast, in the al-Farʿ district of the land of Muzaynah between Mecca and Medina, and it is nearer to Medina.

Points deduced from the hadiths

  1. Rikāz (buried treasure) is whatever is discovered from the pre-Islamic era of ignorance, that is, from those who lived before Islam; or whatever is found from the burial of earlier disbelievers even if they were not people of that era, provided a mark of unbelief appears on all or part of it—such as their names, the names of their kings, their images, or the images of their idols. The finder likewise owns it even when no such mark exists.
  2. Rikāz belongs to the finder, for he has the strongest claim to it, and because ʿUmar and ʿAlī (may Allah be pleased with them) returned the remainder of the rikāz to its finder.
  3. The finder pays one-fifth of it. Ibn al-Mundhir said, “We know of no one who disagreed about this,” for it reached its owner without effort or cost, so the amount due from it is greater than that which involves effort.
  4. There is no minimum threshold (niṣāb); zakāh is due on both small and large amounts, and it may be collected by the Imam or paid directly by the finder.
  5. The time to pay its zakāh is immediately upon discovery; one does not wait for a lunar year to pass.
  6. Its zakāh is taken from the treasure itself, even if it is not coinage—such as iron, lead, and the like—although it is permissible to pay its zakāh from other property.
  7. Zakāh is obligatory on it even if the finder is a dhimmī (non-Muslim subject) or a mustaʾmin (temporary non-Muslim resident) so long as he is within the Abode of Islam.
  8. Its proceeds are spent on the general welfare of the Muslims and are not confined to the eight designated categories; in this respect, the zakāh of rikāz most closely resembles unrestricted fayʾ (state revenue from non-Muslim sources).

Accordingly, it is obligatory upon a non-Muslim, is payable on both small and large amounts, has no waiting period, requires one-fifth, is paid in kind even when it is merchandise, and its disbursement is the disbursement of
