510 – ʿAttab ibn Asīd (may Allah be pleased with him) said: “The Messenger of Allah, peace and blessings be upon him, commanded us that grapes be estimated just as date-palms are estimated, and that their zakat be taken in the form of raisins.” The Five compilers of the Sunan transmitted this report, yet its chain is interrupted. Grade of the hadith
The preponderant opinion is that the report is mursal.
In at-Talkhīs it is stated: Abu Dawud, al-Tirmidhi, al-Nasa’i, Ibn Hibban, and al-Daraqutni narrated it from ʿAttab ibn Asīd, and it hinges on Saʿīd ibn al-Musayyib reporting from ʿAttab. Abu Dawud remarked, “He did not hear from him,” and al-Mundhirī said, “Its interruption is evident, for Saʿīd was born during the caliphate of ʿUmar, whereas ʿAttab died on the very day Abu Bakr al-Ṣiddīq passed away.”
Abu Ḥātim said: “What is authentic is Saʿīd ibn al-Musayyib’s statement that the Prophet, peace and blessings be upon him, instructed ʿAttab”—a mursal report.
Al-Nawawī noted: “Although the hadith is mursal, it is strengthened by the scholars’ acceptance of it.”
Shaykh al-Islām Ibn Taymiyyah said: “This report accords with the principles and noble aims of the Sharia.”
Lessons drawn from the two hadiths
1 – Both narrations indicate that the ruler is obliged to dispatch zakat collectors and agents to levy the zakat on grains and fruits, thereby manifesting this great act of worship, for zakat is one of Islam’s public rites.
2 – They also show that, to determine the amount of fruit or grain subject to zakat, it is sufficient to estimate it by khars and approximate the yield.
