Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

– “The Messenger of Allah exempted them.” Al-Qurṭubī explains that al-ʿafw here means “omission,” that is, he left those items alone and did not establish a ruling for them, therefore they are pardoned; do not busy yourselves with them. The Prophet ﷺ said, “He remained silent about certain matters, not out of forgetfulness, so do not investigate them.” Such is the meaning of their being excused.

  • Points derived from the two ḥadiths:

1 – Ḥadith (507) proves that zakat is obligatory on every type of grain and on all fruits that are measured by volume and can be stored. The text itself cites barley, wheat, raisins, and dates, because staples that people depend on for survival must, by the Lawgiver’s command, carry an apportioned share of zakat for those in need. For grains, liability is conditioned on their being measurable by volume, for that shows the soundness of tying the ruling to them; it is also conditioned on their suitability for storage—whatever cannot be stored does not represent a complete blessing, since full benefit cannot be taken from it.

2 – Shaykh al-Islām said: Aḥmad and other hadith-based jurists obligate zakat on grains in the same way that they obligate it on storable fruits, even if they are neither dates nor raisins. Because such produce endures, crops subject to the tithe take the place of the year-end requirement applied to other assets. They distinguish between vegetables and storable produce on the strength of reports from the Companions. Shaykh al-Islām therefore preferred the view that the decisive criterion for zakat on what the earth yields is storability—nothing else—since the rationale for zakat is present in it. Measurement by volume is merely a method of estimation; weighing serves the same purpose.

3 – As for fruits, vegetables, and legumes, no zakat is due on them, because they are neither storable nor measured by volume. Such items offer only immediate, short-term benefit; the need for them is transient, and they are not basic staples. Rather, they are luxuries and delicacies, food for the affluent more than the poor: “And Allah has favored some of you over others in provision” (Q 16:71). For that reason, according to the majority of scholars, zakat is not obligatory on them.
