Points derived from the ḥadith
- Zakah is obligatory on the wealth of an orphan, and likewise on the wealth of the insane or the feeble-minded. Zakah is linked to the cause that triggers it and therefore attaches to the very property itself, even though it also entails a personal liability. Because it is connected to the asset and to its causal condition, the legal responsibility (taklīf) of the owner is not a prerequisite for its obligation. Zakah is thus a financial act of worship, unlike prayer and fasting, which are purely bodily acts of worship.
- The guardian must discharge the zakah on behalf of the orphan, for all financial dealings are his responsibility.
- With respect to a fetus, no zakah is required on the property ascribed to it, for it has no independent estate while still in the womb.
- It is recommended to grow the orphan’s wealth through trade or similar ventures that the guardian deems likely to yield profit and benefit, thereby increasing the estate. This falls under the mandate to improve the orphan’s situation.
- Great care must be taken with the property of orphans, spending it only on what benefits them and rectifies their circumstances, in accordance with Allah’s words: “Do not approach the property of the orphan except in the way that is best” (al-Māʾidah 152). The Lawgiver protected the orphan’s wealth even from the obligatory charity—zakah—so how much more should it be protected from expenditures that bring no benefit in religion or worldly life!
- Guardianship (wilāyah) over the orphan is a valid sharʿī guardianship that requires acting in the orphan’s best interests concerning both affairs and assets. Allah has promised reward for those who reform their condition and has threatened those who mistreat them or consume their wealth with the severest punishment in the Hereafter.
- Allah’s mercy and kindness toward orphans are evident in His enjoining care for them, establishing living guardians to safeguard and increase their wealth, and to set their affairs aright.
Scholarly disagreement
The scholars are unanimously agreed that zakah is obligatory on the wealth of an adult, sane Muslim. They differed, however, regarding its obligation on the wealth of a minor or an insane person:
Imām Abū Ḥanīfah held that zakah is not obligatory on the property of either the minor or the insane, except
* خلاف العلماء:
