Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

Among the proofs that discretionary punishment may take the form of seizing a person’s wealth are the following:
1 – The Prophet ﷺ allowed anyone who found a man hunting inside the sanctuary of Madinah to appropriate that hunter’s belongings. [Musnad Aḥmad 1381]
2 – He ordered that wine jars be broken and their containers torn open. [Musnad Aḥmad 11744]
3 – He instructed ʿAbd Allāh ibn ʿAmr to burn the two safflower-dyed garments he was wearing. [Sunan Abū Dāwūd 3546]
4 – He doubled the fine imposed on a thief who stole from a place that was not secure. [Sunan Abū Dāwūd 3816]
5 – He demolished Masjid al-Dirār.
6 – He disqualified a murderer from inheriting or receiving a bequest. [Jāmiʿ al-Tirmidhī 2035]
