Resolution of the Islamic Fiqh Academy concerning Autopsy of Human Corpses
Praise belongs to Allah alone. Blessings and peace be upon the one after whom there is no prophet, our master Muhammad ﷺ, and upon his family and Companions.
To proceed:
The Council of the Islamic Fiqh Academy of the Muslim World League, in its tenth session held in Makkah from Saturday 24 Safar 1408 AH (17 October 1987) to Wednesday 28 Safar 1408 AH (21 October 1987), examined the subject of “Autopsy of Human Corpses.” After discussion and deliberation, the Council issued the following resolution:
In view of the necessities that call for autopsy—necessities that render the benefit greater than the harm of violating the dignity of the deceased—the Islamic Fiqh Council of the Muslim World League resolves as follows:
First: It is permissible to dissect human corpses for any of the following purposes:
(a) Investigating a criminal case in order to determine the cause of death or the nature of the crime committed, when the judge finds it difficult to establish the cause of death and it becomes clear that autopsy is the only means to discover it.
(b) Identifying diseases that require autopsy so that, on the basis of the findings, preventive measures can be taken and appropriate treatments devised.
