Points derived from the ḥadith
– The report underscores the gravity of debt: the believer’s soul is kept in pledge until the debt is cleared. “In pledge” means it is withheld from its noble station, as in the ḥadith, “Your companion is being held back at the gate of Paradise because of a debt he owes, until an heir settles it on his behalf,” and similar narrations.
– The rationale is that people’s rights are grounded in self-interest, and they are rarely willing to overlook them.
– Further proof of this severity is the narration recorded by Aḥmad (13745), Abū Dāwūd (3343), and al-Nasāʾī (1962) from Jābir: “The Prophet ﷺ would not perform the funeral prayer over a man who died owing a debt. A deceased person was brought to him and he asked, ‘Does he owe anything?’ They replied, ‘Yes, two dīnārs.’ He said, ‘Pray over your companion.’ Abū Qatādah said, ‘They are on me, Messenger of Allah.’ So he prayed over him. Later, when Allah granted victory to His Messenger, he said, ‘I have a greater claim on every believer than he has on himself; whoever leaves a debt, it is upon me, and whoever leaves wealth, it belongs to his heirs.’”
– Shaykh Muḥammad ibn Ibrāhīm Āl al-Shaykh stated: If a Muslim dies owing a debt, the ruler must pay it from the public treasury (bayt al-māl), as is confirmed by authentic aḥādīth.
– It is mentioned in al-Dalīl wa Sharḥihi that martyrdom wipes out all sins except debt; Shaykh Taqī al-Dīn added: and likewise the injustices done to other people. Muslim (1886) records from Ibn ʿUmar that the Prophet ﷺ said, “Allah forgives every sin of the martyr except debt.”
– If the deceased left an estate, his debts must be settled without delay, for his liability remains bound by them after death until they are discharged.
– If this is the ruling for debt incurred with the lender’s consent through a lawful transaction, how much more serious is the case of property taken by force, plunder, theft, and the like?
– One must hasten to settle the deceased’s debts; if immediate payment is not possible, it is recommended
