Ahmad informed us, ⦗54⦘
10 – Abu Bakr narrated to us, and al-Haytham ibn Kharijah also narrated to us. They said: Yahya ibn Hamzah informed us, from Ishaq ibn ‘Abd Allah—in the book of Ibn Abi al-Dunya it is recorded from Zir ibn Hakim, from Kathir ibn Murrah—that he heard him relating to ‘Abd al-‘Aziz ibn Marwan, from al-Daylami, who said:
“I came as a delegate to the Messenger of Allah ﷺ and said, ‘O Messenger of Allah, we prepare food and a drink and serve it to our relatives.’ He asked, ‘Does it intoxicate?’ I replied, ‘Yes.’ He said, ‘It is forbidden.’
“Later, when I was taking my leave, I raised the matter again and said, ‘O Messenger of Allah, they will not be able to refrain from it.’ He said, ‘Whoever cannot abstain from it—strike off his head.’”
