768 — Ibn Abī Dāwūd also narrated to us, saying: Ishāq ibn Mansūr al-Kawsaj ⦗1195⦘ narrated to us, saying: Sulaymān ibn Harb informed us, saying: Hammād ibn Salamah narrated to us, from Alī ibn Zayd, from Yūsuf ibn Mihrān, from Ibn Abbās, who said: Umar ibn al-Khattāb—may Allah be pleased with him—delivered a sermon and said: “O people, the punishment of stoning is established, so do not let yourselves be deceived concerning it. The proof of this is that the Messenger of Allah—peace and blessings be upon him—carried out stoning, Abū Bakr—may Allah be pleased with him—carried out stoning, and we too have carried it out. There will arise among this ummah people who deny stoning, deny the Dajjāl, deny that the sun will rise from the west, deny the punishment of the grave, deny intercession, and deny that some people will emerge from the Fire after having been charred.”

Muhammad ibn al-Husayn—may Allah have mercy on him—said: Everything Umar—may Allah be pleased with him—foretold has now appeared in this ummah. It therefore behooves people of sound reason to beware of anyone whose doctrine is to deny what Umar—may Allah be pleased with him—said. Concerning each of the matters Umar—may Allah be pleased with him—mentioned, we shall cite reports from the Messenger of Allah—peace and blessings be upon him—showing that belief in and affirmation of them is obligatory. Whoever does not believe in and affirm them has strayed from the path of truth. Allah—Glorious and Exalted is He—has preserved intelligent and learned believers from denying what we have mentioned.

⦗1196⦘ As for stoning, the Messenger of Allah—peace and blessings be upon him—carried it out. The scholars do not disagree that he had Māiz ibn Mālik stoned when he confessed adultery before him. The Prophet—peace and blessings be upon him—also had a woman from Ghāmid stoned after she confessed adultery before him. He also said to Unays, one of his Companions, after a man had told him in a lengthy account that his wife had committed adultery: “O Unays, go tomorrow morning to this man’s wife. If she confesses, stone her.” She confessed, and he stoned her. The Prophet—peace and blessings be upon him—also had two Jews who had committed adultery stoned.

Abū Bakr al-Siddīq ⦗1197⦘—may Allah be pleased with him—carried out stoning, as did Umar—may Allah be pleased with him. Alī ibn Abī Tālib—may Allah be pleased with him—stoned Sharāhah after she committed adultery while previously married. He had her flogged on Friday and stoned on Saturday, saying: “I flogged her according to the Book of Allah—Glorious and Exalted is He—and stoned her according to the sunnah of the Messenger of Allah—peace and blessings be upon him.” This is an established ruling among Muslim jurists. They do not disagree that a previously married adulterer, when witnesses testify against him or he confesses to adultery, is to be stoned, whether male or female, whereas a virgin is to be flogged. The scholars do not disagree about this, so know it well.
