Chapter on Rescission (iqāla)
Rescission is permitted in a sale provided it is carried out at the original price. If the parties stipulate a price lower or higher than that, the stipulation is void and the original price must be returned. According to Abū Ḥanīfa, between the two contracting parties it is an annulment, but in relation to everyone else it counts as a new sale.
The loss of the price does not prevent a valid rescission, whereas the loss of the commodity does. If only part of the commodity has perished, rescission is valid with respect to the remainder.
