Chapter on the Option upon Viewing (khiyār al-ruʾya)

  1. Whoever purchases something he has not yet seen, the sale is valid, but once he sees it he has a choice: if he wishes, he takes it; if he wishes, he rejects it.
  2. A seller who sells an item he has not seen has no such option.
  3. If a person only looks at the face of a heap of grain, the exposed side of a folded garment, the face of a slave-girl, or the face and hindquarters of an animal, he has no option. Likewise, if he has seen the courtyard of a house he has no option, even though he has not seen the rooms.
  4. The sale and purchase carried out by a blind person are valid. When he buys, he retains the option, but it lapses if he:
    – handles the merchandise when it is normally identified by touch;
    – smells it when it is normally identified by smell; or
    – tastes it when it is normally identified by taste.
    With respect to real estate, his option does not lapse until the property has been described to him.
  5. If someone sells another man’s property without his permission, the owner has the option: he may ratify the sale or annul it. Ratification is effective only if the object of sale still exists and both original parties remain as they were.
  6. If a person has seen one of two garments and then buys them both, after seeing the second garment he may return them.
  7. If the holder of the option upon viewing dies, the option lapses.
  8. If someone sees an item and, after a period of time, buys it, then:
    – if it remains in the condition in which he first saw it, he has no option;
    – if he finds it altered, he has the option.

Chapter on the Option for Defects (khiyār al-ʿayb)

  1. When the buyer discovers a defect in the merchandise, he has a choice: he may keep it for the full price or return it altogether; he may not keep it and demand a reduction.
  2. Every flaw that, according to commercial custom, diminishes the price is deemed a defect. Absconding, bed-wetting, and theft are considered defects in a minor slave until he reaches puberty; once he attains puberty
