Al-QudūrīAl-Quduri

But if he stands in the doorway in such a way that, were the door closed, he would be outside, he is not deemed to have broken his oath.

Whoever swears not to eat roast, the oath applies to meat only, not to roasted eggplant or carrots.

Whoever swears not to eat ṭabīkh (stew) is bound only with respect to meat that is cooked as a stew.

Whoever swears not to eat heads, the oath concerns the animal heads that are baked in clay ovens and sold in the marketplace.

Whoever swears not to eat bread, the oath covers whatever the people of his town normally call bread; therefore, if he eats the thin qatāʾif bread or rice bread in Iraq, he is not perjured.

Whoever swears that he will neither sell, buy, nor lease and then assigns an agent to carry that out has not broken his oath.

But if he swears that he will neither marry, divorce, nor pronounce a conditional divorce and then authorises someone else to do it on his behalf, he is perjured.

Whoever swears not to sit on the ground but then sits on a carpet or a reed mat has not broken his oath.

Whoever swears not to sit on a bed and then sits on it while a rug is spread over it is perjured; but if he places another bed on top of it and sits on the upper bed, he is not.

If he swears not to sleep on a mattress and then sleeps on it with a quilt between himself and the mattress, he is perjured; but if he places another mattress on top of it and sleeps on the upper one, he is not.

Whoever swears an oath and, immediately thereafter, says, “if Allah wills,” incurs no liability if he later violates it.

If he swears, “I will certainly come to him, if I am able,” the ability meant is that which comes from sound health, not mere physical power.

If someone swears not to speak to so-and-so for “a ḥīn,” “a zamān,” or using the definite forms “the ḥīn” or “the zamān,” the period is six months; the same applies to “ad-dahr” according to Abū Yūsuf and Muḥammad.

If he swears not to speak to him for “days,” the period is three days. If he says “the days,” it is ten days according to Abū Ḥanīfa, whereas Abū Yūsuf and Muḥammad hold that it is the days of the week.

If he swears not to speak to him for “the months,” the period is ten months according to Abū Ḥanīfa, and twelve months according to Abū Yūsuf and Muḥammad.

When a man swears that he will not do such-and-such, he must refrain from it forever. When he swears that he will do such-and-such, doing it once fulfils his oath.

If a man swears that his wife will not leave the house except with his permission, and he gives her permission once, then she goes out and later goes out again without new permission, he is perjured; permission is required for every outing. However, if he says, “except that I should permit you,” and he grants permission once, then she goes out thereafter without his express permission, he is not perjured.

If a person swears not to take lunch, “lunch” refers to eating from the break of dawn until noon; “dinner” spans from the midday prayer until midnight; and “suḥūr” is from midnight until dawn.
