—may Allah have mercy on them—"The judge should wait until two consecutive instalments fall due."
Once the mukatab is declared incapable, he reverts to the legal rulings of slavery, and whatever earnings he has in his possession pass to his master.
If the mukatab dies while leaving property, the contract is not dissolved; the manumission price is taken from his earnings and he is deemed to have been freed in the very last instant of his life.
If he leaves no assets sufficient to cover the price but leaves a child born during the kitābah, that child must work off the contract on its scheduled instalments; once the amount has been paid, we rule that the father was free before his death and the child is likewise emancipated.
If he leaves a child who had been purchased and incorporated into the kitābah, the child is told: "Either pay the contract price immediately, or you will be returned to slavery."
Should a Muslim contract kitābah with his slave for wine, pork, or for the slave’s own valuation, the contract is void. Yet if the slave actually delivers the wine, he becomes free and must still work to pay its value; the amount may not be less than what had originally been stipulated and, if need be, must be increased.
A kitābah contracted for an unspecified animal is valid. If a master places two of his slaves under one kitābah, each guaranteeing the other, the contract is valid; whichever of them pays becomes free and may recover from his partner one-half of what he paid.
If the master subsequently emancipates his mukatab outright, the slave is freed by that act and the debt of the kitābah is cancelled.
If the master of a mukatab dies, the contract is not annulled. The slave is instructed to pay the price to the heirs on its instalments. If only one heir emancipates him, the emancipation does not take effect; if all the heirs emancipate him, he is freed and the debt is cancelled.
If a master places his umm walad under a kitābah, the contract is valid, and if the master dies the obligation of the kitābah is waived for her.
