the term of the muzāraʿa expires while the crop has not yet ripened, the cultivator must pay rent equivalent to the value of his share of the land until the harvest is completed. All expenses incurred for the crop are borne by both parties in proportion to their respective shares, and the wages for reaping, transporting, threshing, and winnowing are likewise divided between them according to those shares. If, in the muzāraʿa contract, they stipulate that these costs fall solely on the worker, the agreement is invalid.

Chapter on Musāqāt (crop-sharing for orchards)

Abu Ḥanīfah maintained that a musāqāt in which the worker is assigned a portion of the fruit is invalid, whereas Abu Yūsuf and Muḥammad deemed it permissible provided that a definite term is set and an undivided share of the fruit is specified.

Musāqāt is permissible with date-palms, other trees, grapevines, succulent greens, and the perennial stalks of eggplants. If a grove of date-palms already bearing fruit is handed over under a musāqāt arrangement and further labour will increase the yield, the contract is valid; but if the fruit has reached its final stage and can no longer increase, it is not valid.

Should a musāqāt prove invalid, the worker is entitled to a wage commensurate with his effort. The musāqāt is annulled by the death of either party and may be rescinded, after due notice, in the same manner as a lease.
