Al-QudūrīAl-Quduri

that the luqaṭa is his, it is not handed over to him until he produces lawful evidence. If, however, he can state its distinctive marks, the finder is permitted to give it to him, though the court cannot oblige the finder to do so.

The luqaṭa is not to be given in charity to someone who is wealthy. If the finder himself is well-off, he may not derive any benefit from it; but if he is poor, there is no objection to his using it. When the finder is affluent, he is allowed to give it in charity to his father, his son, or his wife, provided they are needy. And Allah knows best.
