CHAPTER ON PARTITION
674—Partition is of two types:
-
Compulsory partition: This applies where partition entails neither harm nor an equalization payment, as with fungible goods, large houses, and extensive properties.
-
Consensual partition: This applies where partition would harm one of the co-owners or require an equalization payment. It therefore requires the consent of all the co-owners.
If one of them requests that the property be sold, the others must accede to his request.
If they lease it, the rental income is divided among them in proportion to their respective ownership shares.

بَابُ اَلْقِسْمَةِ
٦٧٤- وَهِيَ نَوْعَانِ:
١- قِسْمَةُ إِجْبَارٍ، فِيمَا لَا ضَرَرَ فِيهِ، وَلَا رَدَّ عِوَضٍ، كَالْمِثْلِيَاتِ، والدور الكبار، والأملاك الواسعة.
٢- وَقِسْمَةُ تراضٍ، وَهِيَ مَا فِيهِ ضَرَرٌ عَلَى أَحَدِ اَلشُّرَكَاءِ فِي اَلْقِسْمَةِ، أَوْ فِيهِ رَدُّ عوض، فلابد فِيهَا مِنْ رِضا اَلشُّرَكَاءِ كُلِّهِمْ.
وَإِنْ طَلَبَ أَحَدُهُمْ فِيهَا اَلْبَيْعَ: وَجَبَتْ إِجَابَتُهُ،
وَإِنْ أَجَّرُوهَا: كَانَتْ اَلْأُجْرَةُ فِيهَا عَلَى قَدْرِ مَلِكِهِمْ فِيهَا.
