The Prescribed Penalty for Brigandage
644—Allah Most High says concerning brigands: “The punishment of those who wage war against Allah and His Messenger and spread corruption in the land is that they be killed or crucified, or have their hands and feet cut off on opposite sides, or be banished from the land. That is a disgrace for them in this world, and in the Hereafter they will suffer a tremendous punishment” (al-Mā’idah 5:33).
645—They are those who assail people and waylay them by pillaging or killing.
a—Whoever kills and takes property shall be killed and crucified.
b—Whoever kills must be put to death.
c—Whoever takes property shall have his right hand and left foot amputated.
d—Whoever terrorizes people shall be banished from the land1.
(1) The Shaykh states in *al-Mukhtārāt al-Jaliyya* (p. 120) that if brigands inflict an injury for which retaliation in kind is due, its enforcement is mandatory.
حد الحرابة:
٦٤٤- وَقَالَ تَعَالَى فِي اَلْمُحَارِبِينَ: ﴿إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ وَيَسْعَوْنَ فِي الْأَرْضِ فَسَاداً أَنْ يُقَتَّلُوا أَوْ يُصَلَّبُوا أَوْ تُقَطَّعَ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلافٍ أَوْ يُنْفَوْا مِنَ الْأَرْضِ ذَلِكَ لَهُمْ خِزْيٌ فِي الدُّنْيَا وَلَهُمْ فِي الْآخِرَةِ عَذَابٌ عَظِيمٌ﴾ اَلْمَائِدَة: ٣٣.
٦٤٥-وَهُمُ اَلَّذِينَ يَخْرُجُونَ عَلَى اَلنَّاسِ، وَيَقْطَعُونَ اَلطَّرِيقَ عَلَيْهِمْ بِنَهْبٍ أَوْ قَتْلٍ.
أَ- فَمَنْ قتل وأخذ مالاص: قُتِلَ وَصُلِبَ،
بِ- وَمَنْ قَتَلَ: تَحَتَّمَ قَتْلُهُ،
جـ- وَمَنْ أَخَذَ مَالاً: قُطِعَتْ يَدُهُ اَلْيُمْنَى وَرِجْلُهُ اَلْيُسْرَى،
دُ- وَمَنْ أَخَافَ اَلنَّاسَ: نُفِيَ من الأرض١.
١ قرر الشيخ "في المختارات الجلية ص١٢٠": أن قطاع الطريق إذا جنوا بما يوجب قودا في الطرف تحتم استيفاؤه.
