Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

641—If he steals again, he shall be imprisoned.

642—No more than one hand and one foot shall be amputated.

  • Allah Most High says: “As for the male thief and the female thief, cut off their hands” (al-Mā’idah 5:38).

  • Aisha—may Allah be pleased with her—reported that the Prophet said: “A thief’s hand shall not be amputated unless the value stolen is a quarter-dinar or more.” Agreed upon1.

643—It is stated in the hadith: “There is no amputation for stealing fruit still on the tree or palm hearts.” Narrated by the compilers of the Sunan collections2.

(1) Reported by al-Bukhārī (12:96) and Muslim (no. 1684). (2) Reported by Mālik in *al-Muwattaʾ* (no. 32), al-Shāfiʿī in *al-Musnad* (no. 275), Ahmad (3:463), al-Dārimī (2:174), Abū Dāwūd (no. 4388), al-Tirmidhī (no. 1449), al-Nasāʾī (8:87), Ibn Mājah (no. 2593), Ibn Hibbān (*Mawārid*, no. 1505), and al-Bayhaqī (8:263). Al-Hāfiz states in *al-Talkhīs* (4:73): “Al-Tahāwī said, ‘The scholars have accepted the text of this hadith.’” *Thamar* means fruit still hanging from the date palm before it is harvested, while *kathar* means the palm heart—the tender pith at its center. No amputation is imposed because taking property from a *hirz* (a place of secure custody) is a prerequisite for amputation, whereas fruit and palm hearts are not securely stored. According to the three imams, the offender must make restitution equal to their value once; according to Ahmad, however, he must pay twice their value, based on the hadith of Rāfiʿ ibn Khadīj. There is disagreement within the school over whether this doubling applies specifically to fruit and palm hearts or generally to anything stolen from outside a *hirz*. Shaykh al-Saʿdī favored the general application. *Al-Mukhtārāt al-Jaliyya*, p. 120.
