636—Accusing someone who is not legally protected from such accusations is subject to discretionary punishment.
637—A person legally protected from such accusations is one who is free, adult, Muslim, sane, and chaste.
Discretionary Punishment
638—Discretionary punishment is obligatory for every sinful act for which there is neither a prescribed punishment nor an expiation1.
(1) The Shaykh states in *al-Mukhtārāt*, p. 119, that more than ten lashes may be imposed as *ta'zīr* (discretionary punishment). He explains that the Prophet’s words (peace and blessings be upon him), “No one may be flogged more than ten lashes except in the case of one of Allah’s limits,” mean: except for a sinful act. The ten-lash maximum applies only when disciplining a minor, wife, servant, or similar person for conduct that is not sinful.
