The Prescribed Punishment for Accusing Someone of Unlawful Sexual Intercourse
635—Whoever accuses a person legally protected from such accusations1 of unlawful sexual intercourse, or testifies2 against that person to the same effect but the required testimony is not completed, shall be flogged eighty lashes3.
(1) In B and T: “a legally protected person of unlawful sexual intercourse.”
(2) In T: “and testifies.”
(3) The Shaykh states in *al-Mukhtārāt al-Jaliyya*, p. 199, that the prescribed punishment for *qadhf* (false accusation of unlawful sexual intercourse) is a right of Allah Most High and therefore is not waived if the accused person pardons the accuser.

٦٣٥- ومن قذف بالزني مُحْصَنًا١، أَوْ شَهِدَ٢ عَلَيْهِ بِهِ، وَلَمْ تَكْمُلْ الشهادة: جلد ثمانين جلدة٣.
