Prescribed Penalty for Unlawful Sexual Intercourse

633—The prescribed penalty for unlawful sexual intercourse—which is the commission of the indecent act through the vagina or anus—is as follows:

—If the offender is married—meaning that he has married and consummated the marriage while both spouses were free and legally accountable—he is to be stoned to death.

—If the offender is unmarried, he is to be flogged one hundred lashes and banished from his homeland for one year.

634—This is subject, however, to the condition that he confess to it four times, or that four upright witnesses testify against him and state it explicitly in their testimony1.
