of perjury1.
614—If, however, he believes himself to be telling the truth, it is an idle oath, such as saying, “No, by Allah,” or “Yes, by Allah,” in the course of conversation.
615—If he breaks his oath—by doing what he swore to refrain from, or refraining from what he swore to do—expiation becomes obligatory upon him:
a—freeing a slave, or feeding ten needy people2, or3 clothing them.
b—If he lacks the means, he must fast for three days4.
(1) It is called a *ghamūs* oath because it plunges the person who swears it into sin and then into the Fire.
(2) The shaykh states in *al-Mukhtārāt al-Jaliyya*, p. 124: “The correct view regarding all forms of expiation is that feeding the needy suffices—for example, by serving them lunch or dinner. It is not necessary to transfer ownership of the food to them, as indicated by the Quran and Sunnah.” He also held that anyone who swears oaths concerning different acts—such as, “By Allah, I will not eat,” and, “By Allah, I will not drink”—must offer a separate expiation for each oath he breaks, whether or not he has already expiated for one of them. He further held, on p. 109, that someone who performs the act covered by his oath out of forgetfulness or ignorance has not broken the oath. This applies to oaths involving divorce or manumission and to all other oaths.
(3) Manuscript B reads *wa-kiswatuhum* (“and clothing them”). This is an error.
(4) A person may choose either to offer the expiation before breaking the oath or to defer it until afterward. *Nūr al-Basā’ir*, p. 59.
