Chapter on Oaths and Vows(1)

610—An oath is valid only when sworn by Allah, one of His names, or one of His attributes.

611—Swearing by anything other than Allah is shirk, and no valid oath is thereby constituted.

612—An oath that entails expiation must concern a future matter.

613—If it concerns a past matter—and the person knowingly lies—then it is the oath

(1) The shaykh stated in *The Treatise on Legal Maxims and Distinctions*, p. 131: “One valid distinction is that between an oath and a vow. An oath is intended to urge or deter, or to affirm or deny something, and it may be discharged through expiation. A vow, however, entails a servant binding himself to an act of obedience, either unconditionally or contingent upon receiving a blessing or averting a calamity. It must be fulfilled, and expiation does not suffice in its place. This is a *nadhr al-tabarrur* (devotional vow). All other categories of vows are treated in the same manner as oaths.”
