Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

598—When the child reaches seven years of age:

a—If the child is a boy, he is given the choice between his parents and shall remain with whichever parent he chooses.

b—If the child is a girl, she shall remain with whichever parent—her mother or father—best serves her welfare.

599—A child in custody must not be left in the care of anyone who will not safeguard the child and attend to the child’s welfare.1

(1) The Sheikh states in *al-Mukhtārāt al-Jaliyya*, p. 114: “Regarding custody and the precedence of some women over others, I have not been able to establish a satisfactory governing principle. The child’s welfare must, however, be taken into consideration, and whoever best serves that welfare has the stronger claim to custody. … Likewise, the correct view is that preferred by Ibn al-Qayyim in *al-Hady*: an enslaved person, a morally dissolute person, and a married woman—especially if her husband consents—remain entitled to custody. These circumstances do not extinguish their right, since there is no evidence that does so.”
