Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

556—If a woman dislikes her husband’s character or physical appearance, and fears that, by remaining with him, she will fail to fulfill the obligatory rights she owes him, there is no harm in her offering him compensation so that he will separate from her1.

557—It is valid for any amount of compensation, whether small or large, and may be effected by anyone capable of issuing a valid divorce.

558—If, however, it is sought for a reason other than fear that she will fail to observe2 the limits set by Allah, the hadith states: “Any woman who asks her husband for a divorce without good cause will be forbidden even the fragrance of Paradise.” 3.

(1) It does not count as a divorce, even if the wording of divorce is used and divorce is intended, as the shaykh deemed correct in *al-Mukhtārāt al-Jaliyya*, p. 108. The shaykh stated: The same applies when a judge annuls the marriage for a valid cause, such as the husband’s failure to provide the obligatory maintenance or marital relations. No such annulment reduces the number of divorce pronouncements remaining. The resulting separation is irrevocable, but it is not equivalent to a triple divorce. He may therefore remarry her under a new marriage contract, with her consent, a guardian, and witnesses—even during her *idda* (waiting period)—because the waiting period pertains to the husband who rendered the separation irrevocable or from whom the marriage was annulled. *Nūr al-Basā’ir*, p. 51. (2) Manuscript “B” reads “he observes,” while manuscript “T” reads “they both observe.” (3) Recorded by Ahmad, 5:277; al-Dārimī, 2:162; Abū Dāwūd, no. 2226; al-Tirmidhī, no. 1187, who graded it *hasan*; Ibn Mājah, no. 2055; Ibn Hibbān, *Mawārid*, no. 321; and al-Hākim, 2:200, who said: “It is authentic according to the criteria of al-Bukhārī and Muslim.”
