because Allah Most High says, “There is no blame upon you if you divorce women before you have consummated the marriage or specified a bridal gift for them. But give them a parting gift—the man of ample means according to his means, and the man of limited means according to his means—a reasonable provision, a duty upon those who do good” [al-Baqara: 236].
540—The bridal gift becomes due in full upon death or consummation.
541—It is reduced by half whenever separation occurs before consummation on the husband’s part, as in the case of his divorcing her.
542—It is forfeited:
a. If the separation is initiated by her.
b. If he annuls the marriage because of a defect in her.
543—A man who divorces his wife should give her something as a parting gift to console her, because Allah Most High says, “Divorced women are entitled to a reasonable provision—a duty upon those mindful of Allah” [al-Baqara: 241].
