CHAPTER: DEFECTS IN MARRIAGE
—If either spouse discovers in the other a defect of which they were unaware before the marriage contract—such as insanity, leprosy, vitiligo, or the like—they are entitled to annul the marriage.
—If she discovers that he is impotent1, he is granted a period of one year. If the year elapses and his condition remains unchanged, she is entitled to annul the marriage.
—If she becomes fully emancipated while her husband remains a slave, she is given the choice between remaining with him and separating from him2. This is based on the lengthy hadith of Aisha (concerning the story of Barīra)3: “Barīra was given the choice concerning her husband when she was emancipated4.” Agreed upon5.
—If the annulment occurs before consummation, no bridal gift is due.
—If it occurs after consummation, the bridal gift becomes fully due, and the husband may recover it from whoever deceived him.
