CHAPTER: THE CONDITIONS OF MARRIAGE
506—The consent of both spouses is indispensable, except in the following cases:
A—A minor girl, whom her father may compel to marry.1
B—A female slave, whom her master may compel to marry.
507—A guardian is also indispensable.2 The Prophet, peace and blessings be upon him, said: “There is no valid marriage without a guardian.” This is an authentic hadith narrated by the Five.3

(2) The shaykh stated in *al-Mukhtārāt al-Jaliyya*, p. 4, that the unequivocally correct view is that moral uprightness is not a condition for being a guardian; thus, a sinful guardian may contract the marriage of his female ward.

بَابُ شُرُوطِ النِّكَاحِ
٥٠٦- ولابد فِيهِ مِنْ رِضَا اَلزَّوْجَيْنِ إِلَّا:
أَ- اَلصَّغِيرَةُ فيجبرها أبوها١.
ب- والأمة يجبرها سيدها.
٥٠٧- ولابد فيه من الولي٢؛ قال ﷺ: "لا نِكَاحَ إِلا بِوَلِيٍ" حديث صحيح، رواه الخمسة٣.
١ بيَّن الشيخ أن الصحيح، أن الأب ليس له إجبار ابنته البالغة العاقلة على نكاح من لا ترضاه ... "المختارات الجلية، ص: ١٠٣".
٢ قرر الشيخ "في المختارات الجلية، ص: ٤": أن الصواب المقطوع به، أن العدالة ليست شرطا في الولي، فيزوج الوليُ الفاسقُ مُوَلِّيَتَه.
