Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

461—A maternal brother or sister receives one-sixth, while two or more receive one-third, with males and females sharing equally.

462—They do not inherit in the presence of any descendants, nor in the presence of male ascendants.

463—The husband receives one-half if his wife leaves no children1, and one-quarter if she does.

464—A wife, or multiple wives, receives one-quarter if the husband leaves no children, and one-eighth if he does.

465—The mother receives one-sixth when there is a child, or when there are two or more brothers or sisters; otherwise, she receives one-third2.

466—She receives one-third of the remainder in a case involving a husband and both parents, or a wife

(1) Manuscript “Alif” reads: “when there are no children.” (2) The Shaykh deemed the correct view to be that siblings who are themselves excluded from inheritance do not prevent the mother from receiving one-third. He noted that a principle of inheritance law states: “One who does not inherit does not exclude another heir.” *Al-Mukhtārāt al-Jaliyya*, p. 100.
