Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

and kept with him.” Agreed upon1.

447—A hadith states: “Allah has indeed2 given everyone entitled to a right his due, so no bequest may be made to an heir.” Narrated by the compilers of the Sunan collections3. Another wording reads: “unless the heirs wish otherwise.”4

(1) Reported by al-Bukhārī, 5/355, and Muslim, no. 1627. (2) The particle translated as “indeed” is added from manuscript B and the printed edition. (3) Reported by Abū Dāwūd al-Tayālisī, no. 1127; Abd al-Razzāq, no. 16306; Ahmad, 5/167; Abū Dāwūd, no. 2870; al-Tirmidhī, no. 2120, who graded it authentic; Ibn Mājah, no. 2713; and al-Bayhaqī, 6/264. Al-Būsīrī and al-Tahāwī also graded it authentic, while al-Suyūtī and others counted it among the *mutawātir* (mass-transmitted) reports. (4) Al-Dāraqutnī reported it in his *Sunan*, p. 466, and through him al-Bayhaqī, 6/263, from Atā, from Ibn Abbās, as a report attributed to the Prophet. This Atā is al-Khurāsānī, who did not meet Ibn Abbās, as al-Bayhaqī stated. Al-Hāfiz said of him in *al-Taqrīb*: “He was truthful, but made many mistakes, transmitted *mursal* reports with missing links, and practiced *tadlīs* by obscuring his sources.” Al-Bayhaqī also reported a similar statement attributed to the Prophet, 6/264, through Ismāīl ibn Muslim, from al-Hasan, from Amr ibn Khārijah. He said: “It is weak and has also been transmitted through another route.” In *Irwā al-Ghalīl*, 6/96, al-Albānī judged the hadith objectionable (*munkar*): although it was narrated from Ibn Abbās and Amr ibn Khārijah, as well as through other routes from several Companions, the addition “unless the heirs wish otherwise” is absent from all those versions. Al-Dāraqutnī, p. 466, also transmitted a similar report containing this wording from Amr ibn Shuayb, from his father, from his grandfather, as a statement attributed to the Prophet. Ibn Abd al-Hādī said in *al-Tanqīh*, 2/247: “None of the compilers of the Sunan collections reported it. Among its narrators is Sahl ibn Uthmān, whom al-Hākim declared a liar.” Al-Hāfiz said in *al-Talkhīs*, 3/92: “Its chain of transmission is very weak.”
