more entitled to it.” Related by al-Bukhari1.
397—If someone stakes a claim to barren land by encircling it with stones, digging a well without reaching2 its water, or being allotted a tract of land, he has a prior right to it but does not own it until he revives it by one of the aforementioned means3.
1. Al-Bukhārī narrated it (vol. 5, p. 18), with the wording: “Whoever brings land into productive use or develops it…” The wording cited by the author was narrated by Abū Dāwūd (no. 3073) and others, on the authority of Saīd ibn Zayd and others.
2. An addition from “B” and “T.”
3. A person must be prevented from staking a claim to land when he derives no benefit from it and merely excludes others from it. Whoever is first to something freely available—such as land or firewood—or to a place in a mosque or residence in an endowment that does not require a trustee has a prior right to it over others. *Nūr al-Basāir*, p. 39.
